Is an employer obliged to carry out a risk analysis when he/she employs trainees?
Yes, the employer is obliged to carry out an analysis of any risks the trainees might be exposed to. The employer is responsible for the organisation of the health surveillance. The employer shall also ensure prevention measures and the reception of trainees.

Furthermore, the employer will inform the educational institute of the trainee about this risk analysis.
If required, the employer shall subject the trainee to a previous health assessment.

A preventive medical examination for trainees is only compulsory if the trainee:

  • has a function involving increased vigilance;

Who shall pay for the trainee’s medical examination?
If the employer should entrust the educational institute with the organisation of the obligatorily subject employees, then there is an arrangement according to which the External Prevention Service directly pays for the preventive medical examination (via the Funds for Occupational diseases).

The employer shall pay the obligatorily subject employees if the employer:
  • should demand additional technical examinations,
  • should demand a medical examination for categories of trainees for whom no health surveillance is required,
  • does not call in the external service of the educational institute but his own prevention service.
In certain cases the educational institute shall fulfil the employer’s role the above statement then applies to the educational institute. (top)
